THE TERMS AND CONDITIONS HEREIN FORM AN IMPORTANT PART OF YOUR CRUISE RESERVATION AND AGREEMENT WITH BLASGARDEN, INC. (hereinafter “MMC”, or “Company”, or “we”, or “us” or “our”). PLEASE READ CAREFULLY, AS THESE TERMS AND CONDITIONS INCLUDE A RELEASE OF LIABILITY. YOU SHOULD NOT MAKE YOUR CRUISE RESERVATION UNLESS YOU AGREE TO THESE TERMS & CONDITIONS. BY MAKING YOUR RESERVATION, YOU AND ALL PASSENGERS BOOKED ON YOUR CRUISE RESERVATION ARE LEGALLY BOUND BY THESE TERMS & CONDITIONS. YOU UNDERSTAND AND ACCEPT THAT COMPANY HAS THE RIGHT TO UNILATERALLY CHANGE THE TERMS & CONDITIONS AT ANY TIME BY POSTING THE UPDATED DOCUMENT ON THE PRESENT PAGE, WITHOUT THE NEED OF ANY FURTHER NOTIFICATION. YOU ARE STRONGLY ADVISED TO CHECK THE WEBSITE FOR ANY SUCH UPDATES. THE DATE OF THE LAST REVISION OF THESE TERMS & CONDITIONS WILL BE DISPLAYED AT THE TOP OF THIS PAGE.
1. INTRODUCTION
These Terms & Conditions contain important limitations on your rights and the rights of all persons included in your reservation for the cruise, as furtherly described in the relevant cruise itinerary available on the website (the “Cruise”). These are legally binding documents, and by making your reservation on the Cruise, you and all persons listed on your reservation are agreeing to abide by and be legally bound by these Terms & Conditions.
All references to “Passenger(-s)”, “you” or “your” shall have the same meaning as “Passenger” for purposes of these Terms & Conditions and the words Passenger (-s), you or your as used in these Terms & Conditions shall include each person listed on a Cruise reservation and each person, other than “MMC” personnel, vessel crew, artists and artist personnel, who embarks on the Cruise or attends any Cruise or Cruise related event, whether or not listed on a Cruise reservation. All terms shall be considered gender neutral, and pronouns shall refer to the masculine and feminine, as context requires.
2. ACCEPTANCE
By making a reservation for the Cruise, each Passenger, acknowledges that he or she has read and understands (or if a minor, such person’s parent, guardian or representative has read and understands) each and every term, condition, and provision written herein and shall be deemed to confirm acceptance and agreement by each and every person on your reservation to all the Terms & Conditions set forth herein.
3. RESPONSIBILITY
Passenger acknowledges and expressly agrees that “MMC” (and its affiliates) are acting solely in their capacity as tour operators, brokers and independent contractors arranging this Cruise and that “MMC” has no right or ability to control or direct the operational or navigational activities of the vessel or crew in any manner whatsoever whether aboard the vessel or ashore, including and without limitation to, persons furnishing services to the vessel or to the Passengers, including shore side excursions, embarkation and disembarkation to and from the vessel, the condition of the vessel and its equipment. “MMC” neither supervises nor controls the actions of such parties, nor makes any representation either expressed or implied as to their suitability. Passengers shall engage to any activities during the Cruise, on or off the vessel, at their own risk. “MMC” shall have no responsibility for any losses, damage, death, injuries, or claims whatsoever arising out of or relating to activities described in this paragraph.
4. CRUISE FARE
The cruise fare paid by Passenger includes (or as otherwise stated in the “What’s Included” (https://mediterraneametalcruise.com/what-is-included/) page of the Cruise) all entertainment related fees, your accommodation on-board the ship, cleaning and supplies, 3 meals per day (breakfast, lunch, dinner), housekeeping services, use of the ship’s pools, and amenities, port expenses, port passenger taxes and vessel personnel gratuities.
The cruise fare does not include any shore excursions, transportation to/from the vessel, sightseeing or meals ashore, any other special meals or drinks, medical expenses, spa, beauty salon, casino, gaming, onboard shopping, any other items of personal nature, as well as the mandatory supplement fee for payment and ticketing charges of a 8% of the total of the reservation, which will be automatically added as a fee supplement per transaction during checkout.
The cruise fare does also not include incidental surcharges, such as increase of prices due to cost of fuel or other power sources, exchange rate fluctuations, additional port taxes and services, government taxes, VAT. “MMC” and/or the cruise line reserve the right to impose any of these surcharges to the Passenger at any time after the reservation and/or the completion of the Cruise.
All Passengers who are making a reservation are obligated for the full cruise fare and fees of the occupancy level of the selected stateroom during the reservation process.
All prices published on the website under the “Pricing” section are per person and subject to change at any time, without notice, based on availability and at “MMC”‘s sole discretion. Reservations made before such changes will not be affected.
5. ADDITIONAL PAYMENT & TICKETING FEES
A mandatory, non-refundable payment processing and ticketing fee of 8% of the total amount of the reservation will be paid by the Passengers in addition to the cruise fare during checkout.
6. PRICING, PAYMENT METHODS AND TYPOGRAPHICAL ERRORS
Cruise fare rates, as described in the “Pricing” (https://mediterraneametalcruise.com/pricing/) page of the website are per person based on double occupancy. All prices are based on a minimum of two (2) guests per cabin.
You may opt for any of the available payment plans and options, as provided for in the respective “Payment Plans” (https://mediterraneametalcruise.com/payment-plans) page. The date you make your reservation will ultimately determine your total payment due for the booking.
Payment can be made in full or in installments, as specified in the “Payment Plans” (https://mediterraneametalcruise.com/payment-plans) page of each Cruise. If the payment has not been received by “MMC” in whole by the time specified above, “MMC” may, at its sole discretion: a) consider your reservation automatically canceled, or b) contact you, by email or otherwise, and provide you with a new deadline for fulfilling your payment obligations (which shall in no case exceed 5 days) and any failure by you to fully pay the cruise fare within this new deadline shall then be considered as cancellation by you. In both cases, cancellation penalties, as applicable, will be imposed and any deposits or installments already paid will not be refunded. Payments will be reflected on your Credit Card or Bank Statement as payments to BLASGARDEN.
Unless otherwise provided, all payments shall be made in US Dollars (any currency conversion charges of card transactions shall be borne by the Passenger).
The currency on board is Euro. Foreign exchange facilities are available at the Purser’s office of the vessel.
Payment methods accepted are most major credit cards including Visa, Mastercard and American Express.
ALL PAYMENTS ARE NON-REFUNDABLE (unless otherwise expressly provided herein or in the “Pricing” (https://mediterraneametalcruise.com/pricing/) or the “Payment Plans” (https://mediterraneametalcruise.com/payment-plans) pages of the Cruise).
The cruise fare’s pricing and payment terms described herein and in the “Pricing” (https://mediterraneametalcruise.com/pricing/) and the “Payment Plans” (https://mediterraneametalcruise.com/payment-plans) pages of the Cruise shall supersede any quotes, offers, payment terms, representations and warranties provided by the cruise line or any of its affiliated entities, either by contract, general terms of otherwise.
In the event that a stateroom rate listed and/or quoted and/or advertised through the website or travel agent or any other source is booked and is incorrect due to a human error, typographical error or technical error, “MMC” reserves the right to correct the erroneous error and request by the Passenger to pay the correct amount or cancel upon the Passenger’s written instructions the booking and make a full refund of the price already paid by the Passenger. Under no circumstances shall “MMC” be liable in any manner whatsoever, including without limitation to honor any such booking resulting from the error.
7. SINGLE PERSON SUPPLEMENT
All stateroom prices published on the website are based on a minimum of double occupancy. Single Passengers will receive a discount of $199 on the full double-occupancy rate for the cabin of their choice, or as otherwise provided in the “Pricing” (https://mediterraneametalcruise.com/pricing/) page of the Cruise.
8. CHILD RATES
As stateroom prices are based on a minimum double occupancy, children 11 years old or younger (at the time of sailing), reserved in cabins as the 3rd and/or 4th Passenger, together with 2 full fare adults, will be eligible for a 20% discount on the base fare. However, if a child of 11 years old or younger is booked as the 2nd Passenger in the cabin, the full adult fare shall apply. For children older than 11 years old, full cruise fare applies in any case.
Passengers making their reservations through the website will need to book their staterooms at the total occupancy level for all persons, including children. For example, a Quad cabin must be booked if 2 adults and 2 children are sailing together. Upon completion of the online reservation, Passengers should contact “MMC”, by emailing at: reservations[at]mediterraneametalcruise.com providing the necessary documentation as well as their reservation code in order to receive a refund and have their payments adjusted based on this clause.
09. RESERVATIONS
At the time of reservation all legal names of all Passengers booked in the same reservation should be provided, as written in their travel documents.
Other details like meal preferences and disability should be also provided in the reservation form. There will be no other chance to submit Passenger’s special requests and “MMC” and/or the cruise line in no case shall be liable or responsible for any loss, damage, cost, or expense of any kind (including, but not limited to, actual damages, consequential damages, or travel-related expenses or damages) to any Passenger or any other person caused by Passenger’s failure to provide such details in the reservation form.
10. PASSENGER CANCELLATION POLICY
Due to the unique nature of our Cruise and its related events, we have a very strict “NO REFUND/CANCELLATION” policy. No refunds will be issued, unless due primarily to the fault of “MMC” (see below). Therefore, we HIGHLY recommend that Passengers consider purchasing travel insurance.
Travel Insurance is NOT included in your reservation. The purchase of insurance is the sole responsibility and choice of each Passenger sailing and is NOT offered through “MMC”. It is up to each PASSENGER to research and decide on a 3rd party vendor of his or her choice for insurance, if they choose to do so. “MMC” is not responsible for any losses, damages and/or any and expenses incurred by the Passenger due to lack of travel insurance.
Although no refunds will be given, in case you need to cancel your reservation, the Passenger that made the reservation providing his/her email and/or phone number must fill out, sign electronically and submit the “Reservation Cancellation Request Form” that is available under request at reservations[at]mediterraneametalcruise.com BEFORE the reservation will be canceled.
11. CANCELLATION OR POSTPONMENT OF CRUISE BY “MMC” AND/OR THE CRUISE LINE
In the event of labor strikes or disputes, lockouts, extreme weather, government restriction, illness of key personnel, public health issues (i.e., viruses, diseases, contagions, pandemics, air quality or other health or environmental issues that might affect the health of Passengers and/or crew), earthquake, tornado, tsunami, flood, medical or lifesaving emergencies, unexpected vessel damage or unavailability, war, riots, civil unrest, or for any other reason whatsoever primarily beyond the control of “MMC” and/or the cruise line (each of the above a “Force Majeure Event”), “MMC” and/or the cruise line in their sole discretion, may:
(i) cancel, advance or postpone the Cruise in part or in its entirety;
(ii) cancel, cut short, or extend any stop at a port of call;
(iii) alter the Cruise itinerary;
(iv) reduce the duration of the Cruise;
(v) provide for alternate, land-based accommodations at a port of call; and/or
(vi) substitute another vessel.
In the event of cancellation of the Cruise because of the occurrence of a Force Majeure Event, there will be NO REFUNDS of your fare/ticket price paid. “MMC”’s sole obligation to you shall be to provide you with a credit, equal in amount to your fare/ticket price paid, toward a future “MMC” cruise or comparable alternative land-based event organized by “MMC”. “MMC” shall not be held responsible for Passenger deposits held by the cruise line, but not refunded to “MMC”, upon cancellation as a result of a Force Majeure Event and such amounts may be deducted from Passenger’s credit as equal per above.
In the event of a postponement of the Cruise because of the occurrence of a Force Majeure Event, there will be NO REFUNDS of your fare/ticket price paid. “MMC”’s sole obligation to you shall be one of the following, at your option: (i) Your reservation will be moved to a comparable room on the rescheduled Cruise, at no additional cost to you (excluding any and all transportation costs to and from the rescheduled Cruise); or (ii) You will receive a credit equal to your fare/ticket price paid toward a future “MMC” cruise or comparable alternative land-based event organized by “MMC”. You are kindly requested to notify us about your option within thirty (30) days from the announcement of the dates of the rescheduled Cruise. Failure to notify us on time will be considered as choice of the option (ii) above.
In the event of cancellation or postponement of the Cruise for reasons that are primarily within “MMC”’s control (for example, for reasons other than a Force Majeure Event, but not including reasons caused substantially by the cruise line), “MMC’s ” sole obligation to you shall be one of the following, at your option: (i) to return your fare/ticket price paid, less a pro-rata deduction if the Cruise is only partially cancelled, or (ii) to give you a credit equal to your fare/ticket price paid towards a future “MMC” cruise or comparable alternative land-based event organized by “MMC”.
“MMC” will not knowingly sell more cabins than the available number of cabins set forth in its agreement with the cruise line. However, in the event the cruise line reduces the available number of cabins for the Cruise below the number stated in its agreement with us for any reason (for example only, for reasons of safety, Passenger health, or in order to comply with government safety/health guidelines related to COVID-19), and if “MMC” at the time of such reduction has already accepted more cabin reservations than would be available because of such reduction, “MMC” may, in its sole discretion, have to cancel your reservation, irrespectively of the date and/or order of such reservation in comparison to other reservations. In such an event, “MMC”’s sole obligation to you shall be one of the following, at your option: (i) to return your fare/ticket price paid, or (ii) to give you a credit equal to your fare/ticket price paid towards a future “MMC” cruise or comparable alternative land-based event organized by “MMC”..
Other than as set forth above, “MMC”, the cruise line, and their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors shall have no liability of any kind to Passengers for any loss, liability, or claims whatsoever in connection with (i) the cancellation or postponement of the Cruise, (ii) change in itinerary or ports of call, (iii) duration of the Cruise and/or (iv) the vessel deployed for the Cruise.
12. BOOKING MADE VIA TRAVEL AGENCIES
Customers who choose to make bookings through travel agencies acknowledge that “MMC” is not liable for any issues, claims, or disputes arising from their booking. All terms and conditions outlined herein apply equally to bookings made through travel agencies. Any matters relating to the booking, including changes, cancellations, or specific requests, must be addressed directly with the travel agency through which the booking was made. “MMC” will not be responsible for any miscommunications, errors, or omissions resulting from third-party bookings.
13. NO-SHOWS
You are kindly advised to be at the departure point of the Cruise at least 60 minutes before the boarding time stated on your ticket. There will be no refunds given for those who do not board the vessel on time, unused tickets, or after the Cruise has occurred. If a flight or other delay for any reason prevents you from joining the Cruise by the boarding time on the departure date, you will be considered a no-show, and we cannot provide a full or partial refund or credit toward a future cruise. The same applies to any delay or failure by the Passenger to return to the vessel on time after disembarkation to any port of call during the Cruise.
PLEASE NOTE THAT THE CANCELLATION/REFUND PROVISIONS OF SECTIONS 11, 12 AND 13 APPLY TO THE CRUISE, REGARDLESS OF ANY REPRESENTATIONS MADE BY THE CRUISE LINE, WHETHER IN ITS PASSENGER CONTRACT TERMS OR ELSEWHERE. ANY RIGHTS THAT MAY BE GRANTED TO PASSENGERS BY THE CRUISE LINE RELATING TO CANCELLATIONS AND REFUNDS ARE SUPERSEDED BY THESE TERMS & CONDITIONS AND SHALL NOT BE APPLICABLE.
14. ARTIST CANCELLATION, ILLNESS, FAILURE TO APPEAR OR PERFORM
“MMC” has entered into an agreement with each performing artist or band (hereinafter the “Artist-s”) that will perform during the Cruise, as applicable, under which the Artists are to be present on board the Cruise and appear and perform in accordance with terms specified therein. However, neither “MMC” nor cruise line shall be liable or responsible in any way to Passengers or others for the failure of any Artist to appear on board or to perform under Artist’s agreement with “MMC”. Further, neither “MMC” nor cruise line shall be liable or responsible for any loss, damage, cost, or expense of any kind (including, but not limited to, actual damages, consequential damages, or travel-related expenses or damages) to any Passenger or any other person or entity (i) in the event that such performance or appearance does not occur because of the failure of any Artist to appear on board or to perform pursuant to such Artist’s agreement with “MMC”, (ii) because such appearance or performance by an Artists prevented or caused by or results directly or indirectly from any Force Majeure Event, (iii) in case of Artist’s appearing on board but being unable or unwilling to fulfil all of Artist’s responsibilities required under its agreement with “MMC” or (iv) in case Artist’s performance is below Passengers’ reasonable expectations.
In the event of any failure of the Artists or part thereof to perform during the Cruise through no substantial fault of “MMC”, “MMC”, in its sole discretion, may (but shall have no obligation to) engage a replacement artist, band, or artists, schedule additional performances by other artists appearing on board, or may change, postpone or terminate all or any part of the Cruise or the entertainment program or change the program or itinerary.
Regardless, “MMC”, shall have no liability of any kind to any Passenger for any loss, damage, cost or expense whatsoever suffered or incurred by Passenger by reason of such failure or change. If any Artist does not appear on board to perform during the Cruise, or appears on board but is unable to or does not perform on board through no substantial fault of “MMC”, Passenger shall have no right to cancel his/her agreement with “MMC” with respect to the Cruise, to receive any refund of any monies paid to “MMC” in connection with the Cruise, or to receive any other monies or remedy from “MMC” and “MMC” shall have no liability or responsibility of any kind to Passenger, including but not limited to liability for actual damages, consequential damages, or travel-related expenses or damages.
15. NAME CHANGE, TRANSFER AND UPGRADES BY THE PASSENGER
The Passenger who makes a reservation for a cabin onboard is considered the cabin’s “Primary Passenger” and holds the sole responsibility for initiating or approving all modifications to the reservation.
The Primary Passenger is solely responsible for initiating or authorizing changes including Guest name changes, extra Guests in cabin and cabin type upgrade, to the reservation, and must agree in writing to any changes made to the reservation, and must submit all requested changes using our “Reservation Change Request Form” that is available under request at reservations[at]mediterraneametalcruise.com, providing the reservation confirmation code as well as the full name, email, and phone number used in the reservation.
Please note that not all cabins can accommodate 3 or 4 guests. Cabins that can fit more than two passengers are limited, and MMC cannot guarantee the addition of extra guests at a later date. Guests attempting to add more passengers than the occupancy of their initial cabin choice may do so, but MMC cannot guarantee that their stateroom will accommodate the new occupancy after the original booking date. This may require a change of cabin location or an upgrade in category, subject to availability. Passengers are, therefore, advised to avoid or limit any subsequent additions and MMC assumes no liability for any inconvenience hereof.
Changes can be made up until 90 days prior to sailing (if allowed by the cruise line), and will be subject to the following administrative fees per change (or as otherwise stated in the “Changes & Cancellations” (https://mediterraneametalcruise.com/changes-and-cancellations/) page of the Cruise):
– $50 for changes (excluding Primary Passenger’s name change) requested 240 days before the date of sailing or before
– $100 for changes (excluding Primary Passenger’s name change) requested 239 – 180 days before the date of sailing
– $150 for changes (excluding Primary Passenger’s name change) requested 179 – 120 days before the date of sailing
– $250 for changes (excluding Primary Passenger’s name change) requested 119 – 90 days before the date of sailing
All new Passengers must agree to these Terms & Conditions before the change is accepted.
The primary passenger of a reservation may request an upgrade of the cabin category at any time, subject to availability and a Booking Change Fee of $250.00. Please note that downgrading your cabin to one of a lower value is not permitted.
The modification of the Primary Passenger’s name is considered a cabin transfer and is subject to a transfer fee of $250 payable to MMC.
No transfer or change of a reservation to a NEW Passenger shall be made without “MMC”’s prior written approval, to be given or withheld in “MMC”’s sole discretion. If the Primary Passenger or other Passenger wishes to transfer the reservation, cabin or berth to a NEW Passenger, the Primary Passenger shall send a request in writing to “MMC” using our “Reservation Change Request Form” for approval of this transfer. If the request is approved by “MMC”, the NEW Passenger must make a deposit equal to cruise fare for the reservation (as applicable on the date of the change request), plus the applicable change administration fee as per above. Once that payment has been made, then the amounts paid by the original Passenger will be refunded directly to the original Passenger, if applicable.
Where “MMC” agrees to the transfer, both the original Passenger and the NEW Passenger shall be jointly and severally liable for the payment of any balance due and for any reasonable additional fees, charges or other costs arising from the transfer.
Subject to the above, under no circumstances shall a Passenger or any person or entity acting on Passenger’s behalf (i) sell a reservation, cabin, or berth to any other person or entity for more than the price paid by the Passenger, or (ii) offer the reservation, cabin or berth to any other person(s) or entity(s) as a prize or award in a drawing, contest, lottery, sweepstakes, raffle or similar event of any kind.
A transfer in violation of this Section shall not be permitted, and the Primary Passenger shall indemnify and hold harmless “MMC”, its officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors from and against any damages, losses and claims suffered by “MMC” as a result of a violation by Primary Passenger, or any other Passenger listed on the reservation, of this Section. In addition, any NEW Passenger sailing with a reservation transferred to him/her for which the terms of this Section have not been followed, may be denied boarding by “MMC” or, in “MMC”’s sole discretion, removed from the Cruise at any port, at such NEW Passenger’s sole cost.
16. RIGHT TO CHANGE ITINERARY
“MMC” and/or the cruise line reserve the right, at any time, to change the Cruise itinerary, including ports of call, duration of stays at ports, departure times, arrival times, embarkation times, and/or disembarkation times, whenever advisable or necessary, within their sole discretion, subject to timely and proper notification to the Passengers. In such cases, “MMC” and/or the cruise line will NOT be responsible to Passengers for any loss or expenses caused by reason of such changes or abandonment. Refunds will NOT be made to Passengers who elect not to complete the Cruise for any reason or cause whatsoever.
17. PORTS OF CALL
You assume sole responsibility for your own safety in any port of call. “MMC” and cruise line do not guarantee your safety at any time of stay off the vessel.
You acknowledge that existing or forecast of severe weather conditions or any other Force Majeure Event that may affect in any way the scheduled ports of call or the cruise path, may prohibit the vessel from docking at scheduled ports of call or may advance or delay the time of arrival at or leaving from scheduled ports of call. In such case, “MMC” and/or the cruise line will NOT be responsible to Passengers for any loss or expenses caused by reason of such inability to dock at one or more scheduled ports of call or change in arrival or departure times.
18. SHORE EXCURSIONS & CRUISE AMENITIES
You acknowledge that all shore excursions and tours, however conducted, airline flights and ground transportation and any ship physician, nurse and on board concessions (including, without limitation, gift shops, spa, beauty salon, fitness center, golf and art programs, and video/snorkel concession) are operated by independent contractors and not by “MMC”. “MMC” neither supervises nor controls their actions, nor makes any representation, whether express or implied, as to their suitability. These services are provided only as a convenience for you, and you are free to use or not use them. You agree that the “MMC” assumes no responsibility, does not guarantee performance and in no event shall be liable for any negligent or intentional acts or omissions, loss, damage, injury or delay to you and/or your property in connection with these services. You use them at your own risk.
19. SHUTTLE BUS
By purchasing the shuttle bus service, customers acknowledge that it is their sole responsibility to be present at the designated pick-up locations at the scheduled times. Neither “MMC” nor the shuttle bus company shall be liable for any missed connections, delays, personal injuries, loss of property, or any other incidents occurring before, during, or after the shuttle service.
Refunds for the shuttle bus service are not available under any circumstances, including, but not limited to, late arrival, failure to board, or cancellation by the customer.
Customers further understand that the bus company operates independently, and “MMC” is not liable for any claims that are not attributable to the gross negligence or willful misconduct of ‘Company’, or their respective officers, directors, agents, employees, or affiliates.
20. AGE REQUIREMENTS
Passengers must be 18 years of age on or before the date of departure in order to reserve a cabin for the Cruise. Passengers under the age of 18 MUST travel with a relative or guardian of 18 years of age or older. Infants must be at least 6 months at the time of sailing.
When minors (under 18) are not traveling with an adult relative or guardian, they must provide an original signed letter of consent from the absent parent/legal guardian that authorizes the minor’s travel and further authorizes medical treatment in case of an emergency, which must be delivered to a cruise line’s representative at the pier during check-in. Failure to provide this letter at embarkation may result in boarding being denied, with no refund of cruise fare provided.
Please note that adult Passengers are responsible for the safety and behavior of their minor co- Passengers.
Passenger ages will be verified at embarkation. Passengers not conforming to the requirements set forth herein will be denied boarding and assessed a 100% cancellation penalty. NO exceptions will be made at embarkation.
21. TRAVEL DOCUMENTS
“MMC” strongly recommends that all the Passengers travel with a passport, valid for at least six months beyond the completion of the Cruise.
It is Passenger’s sole responsibility to check with the competent authorities the travel documentation requirements applicable to the Cruise (and all the ports of call thereof). Passenger acknowledges and accepts that “MMC” has no responsibility for any inability of the Passenger to join and/or complete the Cruise and for any inconvenience brought to the Passenger due to the lack of the necessary travel documentation. “MMC” may, at its sole discretion and to the extent of its duty, deny the embarkation to the vessel and/or disembarkation to any port of call of such Passenger for the reasons stated above.
The name of all Passengers booked on each cruise reservation/ticket MUST MATCH the name on their travel documentation.
22. HEALTH & MEDICAL INCIDENTS
The Passenger must ensure that they are medically and physically fit for travel and have a fully comprehensive travel health insurance policy covering medical treatment and repatriation. Passengers with medical history or problems are advised to seek advice from their doctor before travelling. While at sea or in port, the availability of medical care may be limited and/or delayed. You acknowledge that all or part of the Cruise may be in areas where medical care and/or evacuation may not be available
Passengers who have a medical condition that may be aggravated or exacerbated by strobe lighting, laser lighting and/or synthetic theatrical smoke, are urged to use caution when attending these performances. Passengers agree to enter these areas at their own risk and are solely responsible for removing themselves from any area where these stage production elements are being used.
In the event Passenger fails to exercise such care and prudence and suffers injuries and/or medical incidents as a result, “MMC” and the cruise line shall have no liability or responsibility to Passenger for such injuries and/or medical incidents, and Passenger irrevocably waives the right to make any claim and/or to seek damages of any kind against “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors arising out of or relating to such injury/medical incident.
23. SPECIAL ASSISTANCE & NEEDS
By booking the Cruise, you represent and warrant to “MMC” and the cruise line that you, and those traveling with you, are physically fit to travel at the time of embarkation. You must notify “MMC” at the time of booking of any disability or other medical or physical condition that may require special assistance during the Cruise. Your failure to do so will release “MMC” from any liability for loss, damages or other compensation arising from or related in any way to such disability or condition. “MMC” and the cruise line reserve the right to require that any Passenger who is not self-sufficient travel with a companion who shall take responsibility for any assistance needed during the Cruise and in case of emergency.
If a Passenger has any particular conditions, disability or reduced mobility which require personal care or supervision, then such personal care or supervision must be organized by the Passenger and at the Passenger’s expense. The vessel is unable to provide respite services, one-to-one personal care or supervision or any other form of care for physical or psychiatric or other conditions.
Since the cruise vessels are not equipped for assistance during pregnancy or childbirth, reservations cannot be accepted from Passengers who, at the scheduled date of departure, have entered the 24th week of pregnancy. “MMC” retains the right to seek any information related to such Passengers, in order to verify their pregnancy status, either before or during the Cruise and may – at its sole discretion – deny boarding or continuation of the Cruise for such Passengers. “MMC” is not liable and takes no responsibility if the vessel and or the doctor are unable to provide necessary treatment for such Passengers. The doctor on board is not qualified to deliver babies or give pre or post-natal treatment. Women who will be up to 23 weeks pregnant by the end of the Cruise are required to produce a medical certificate of fitness to travel.
Infants under six (6) months old by the date of departure are not eligible to cruise and will be denied boarding.
24. LUGGAGE & PERSONAL STUFF
“MMC” and cruise line assume no responsibility or liability for loss, including by theft, of your luggage and/or possessions during the Cruise. You are encouraged to NOT bring valuable items with you.
All luggage must be stored in the Passenger’s cabin. Pets, dangerous or illegal items such as weapons, explosives, combustible substances, non-prescription controlled substances, or illegal drugs may not be brought onboard the ship. Any such items shall be surrendered to security at embarkation and may be disposed of at the sole discretion of cruise line. All luggage, both hand-carried and checked, is subject to search for security reasons.
Any luggage left at the pier or on the vessel after final debarkation will be forwarded to Passenger’s address only at the Passenger’s expense. Claims for luggage loss or damage must be made in writing to debarkation personnel prior to leaving the pier area.
25. DOOR DECORATIONS POLICY
For the safety of all passengers, “MMC” and the cruise line do not permit any type of door decorations, including paper, magnetic, or any other form of decor, due to their flammable nature. We kindly ask for your understanding and cooperation with our safety policy. “MMC” and/or the cruise line reserve the right to remove any decorations found in violation of this policy and accept no liability for any damage or loss that may result from the removal of such decorations.
26. VENDING
You may not sell, promote, distribute or offer for sale any merchandise, goods, souvenirs or other products on the Cruise without first obtaining “MMC”’s written approval.
27. PHOTOGRAPHY & VIDEO
“MMC” and/or its promotional partners will have photographers, videographers and the like on the Cruise to film or photograph during the Cruise and such footage is to be used for the promotion of future “MMC”’s events, including but not limited to “MMC”s websites and social media. When the video team or camera crew is shooting in any particular location/venue on the vessel, it is possible that you will be photographed and/or filmed during your presence in said location/venue. If you do not wish to be photographed and/or filmed, please notify the video or camera crew and be prepared for them to ask you to exit the location/venue for a short time until taping/shooting is complete. In case you become aware that you have been photographed and/or filmed without your permission, please visit our Privacy Policy in order to get more information about your rights.
28. PHOTO POLICY FOR PASSENGERS
Passengers may be permitted to take photos onboard the Cruise and during performances with small, non-professional digital cameras and cell phones. Out of respect for our Artists and your fellow Passengers, we ask that you please NOT use flash during shows, especially in all in-door concert venues. Professional quality cameras with detachable lenses and video specific cameras are strictly prohibited. In addition, any and all videotaping or audio recording of performances, appearances, Q&As, etc. is prohibited. All Passengers are requested to be respectful of all Artists’ personal space and time between shows and refrain from photo/autograph requests.
29. REFUSAL OF PASSAGE
Admission on the Cruise may be denied to any person who, in “MMC”’s or the cruise line’s sole discretion: (1) is or becomes in such a condition as to be unfit to travel; (2) is dangerous or obnoxious to others; (3) has a communicable disease or illness that may be harmful to others (including testing positive for COVID-19); or (4) is inadmissible to the any country of debarkation.
In addition, “MMC” and the cruise line reserve the right to refuse passage, to disembark or to confine to a stateroom any Passenger whose physical or mental condition or behavior they consider, in “MMC” and/or the cruise line’s sole discretion, to constitute a risk to the person’s own well-being or the well-being of any other person, and such person waives all claims relating to such actions by “MMC” and/or the cruise line. “MMC” and/or the cruise line have the right to disallow booking or boarding to any Passenger, who in the opinion of “MMC” and/or the cruise line may impact the Cruise, the business or reputation of “MMC” and/or the cruise line, other Passengers, or Artists in a negative or disruptive way. “MMC” and the cruise line shall have full discretion and unilateral rights to make any such decisions. “MMC” and the cruise line shall have no liability to any such person or any third party for damages or claims arising out of any such decisions described in this Section. Any costs resulting from “MMC” and/or the cruise line’s decision, including, without limitation, costs of lodging and transportation, shall be the responsibility solely of such inadmissible persons.
30. PASSENGER DUTY
Passenger, or if a minor, his or her parent or guardian, shall be liable to, and shall reimburse and hold harmless “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors for any damage to the vessel and/or the property of the cruise line, the “MMC”, the Artists and/or other Passengers, caused directly or indirectly, in whole or in part, by any willful or negligent act or omission on the part of the Passenger or the minors under his or her watch and shall further indemnify “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors against all liability which the above parties may incur towards any person or company or government for any personal injury, death or damage to property caused directly or indirectly, in whole or in part, by any willful or negligent act or omission on the part of Passenger and/or the minors under his or her watch.
Passenger has a duty to exercise reasonable care and prudence in Passenger’s conduct during the Cruise. In the event Passenger fails to exercise such care and prudence and suffers injuries as a result, “MMC” and the cruise line shall have no liability or responsibility to Passenger for such injuries, and Passenger irrevocably waives the right to make any claim and/or to seek damages of any kind against “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors arising out of or relating to such injury.
31. PASSENGER CONDUCT RULES
During the Cruise, Passenger shall abide by and conduct him/herself in accordance with all rules, regulations and directions of “MMC” and/or cruise line (the “Rules”), including the Rules set forth in these Terms & Conditions and the Rules of which Passenger is made aware during the Cruise (including all COVID-19 safety/health protocols).
The Rules include, but are not limited to, the following: during a performance, presentation, question and answer session, or other event, Passenger shall not (i) attempt to move onto a stage on which any Artist is performing, (ii) climb onto poles or other structures near the stage, (iii) throw anything onto or towards the stage, or (iv) do anything that may interfere with a performance, with the audience’s enjoyment of the performance, or with the safety of any person. Passenger acknowledges that there may be security personnel present at performances to enforce the Rules and to protect the Artists and the enjoyment of the performances by the audience. Passenger agrees to immediately comply with the requests of security personnel.
During the Cruise, including all performances and events, it is forbidden for Passengers to:
- try to access areas or sections during performances that are restricted to certain ticketholders unless your ticket permits such access (i.e., VIP areas, backstage areas, artists’ lounges);
- climb onto ladders, tables, fences, lighting equipment (including towers and columns), sound equipment, or other equipment related to performances;
- obstruct entrances and exits to the performance areas or fail to move out of an area if directed by security;
- wear a disguise to avoid being recognized at a Cruise event if Passenger has been barred from attending such event;
- wear clothing, hold up signs, harass other Passengers, Artists and/or vessel crew, make gestures, or otherwise do anything that in the reasonable discretion of “MMC”, cruise line or security personnel are xenophobic, offensive, pornographic, illegal, discriminatory, or racially motivated;
- be under the influence of illegal drugs or substances and/or act in a way to reasonably cause security personnel to believe that you are in an impaired state (such as being inebriated);
- disturb the enjoyment of the Cruise by other Passengers or compromise the safety of any person;
- throw or shoot any object in a manner that may be harmful to others or that may interfere with the enjoyment of the Cruise by another person;
- refuse to follow the directions of security personnel;
- litter in any fashion;
- denude in any way and in any of the vessel’s public areas;
- put any person in danger for their safety or well-being, or engage in a fight or other altercation with any person onboard the Cruise;
- steal any possessions of any person or entity.
In the event of a violation of the Rules or these Terms & Conditions by Passenger during a performance and/or the Cruise, Passenger acknowledges that security personnel will act quickly to protect the Artists, other Passengers, and cruise line and “MMC” personnel, and to prevent Passenger from disrupting the performance or creating safety issues for others. Such action may include prohibiting Passenger from attending Cruise performances and events, and/or removal from the Cruise. Passenger hereby irrevocably releases “MMC” and/or cruise line from any injuries, claims or losses suffered by Passenger as a result of the actions of security or other personnel (including physical acts) in the event of Passenger’s violation of these Rules or Terms & Conditions.
32. ZERO-TOLERANCE DRUG POLICY
“MMC” has a zero-tolerance policy when it comes to the use, possession, purchase or distribution of illegal controlled substances. Any violation of this policy will result in disembarkation from the vessel as well as the responsible individuals being turned over to the local law enforcement officials for appropriate legal action, in “MMC”’s discretion. In such cases, no refund shall be given, and “MMC” and cruise line shall not be liable for any refund or other compensation or damages.
33. LIQUOR & BEVERAGE POLICY
Passengers are prohibited from bringing any alcoholic beverages (including bottles of wine), non-alcoholic beverages or any food onboard. Alcoholic beverages will not be sold or served to anyone under the age of 18. We reserve the right to refuse the sale of alcoholic beverages to anyone. Alcoholic beverages purchased in the vessel’s gift shops or in ports of call will be retained by the cruise line until the end of the Cruise.
34. SMOKING
All forms or smoking including but not limited to cigarettes, cigars, pipes, vaporizers, electronic cigarettes are not to be smoked in cabins, waste convenience areas and public areas on board the vessel, except on open decks with designated signs. Cigarette smoking is allowed only in designated areas in the vessel’s public areas. The dining rooms have been declared as non-smoking areas. Any violation of this policy will result in a €500 charge and may also result in the disembarkation of all Passengers in the stateroom. Passengers who are disembarked for violating our policy will be responsible for all financial charges and expenses to return home, and no refund of their unused cruise fare will be provided. Additionally, they may be prohibited from sailing with the “MMC” and/or the cruise line in the future.
35. PARTICIPATION IN ON-BOARD ACTIVITIES
Participants in any on-board activities, including but not limited to the gyro contest, beer contest, and Star Wars battle, must be at least 18 years old (21 years old if a U.S. citizen). All participants must be physically fit and capable of safely taking part in the activities, and they participate entirely at their own risk.
By choosing to participate, customers agree to hold harmless “MMC” and/or the cruise line, and acknowledge that neither “MMC” nor the cruise line shall be liable for any personal injuries, accidents, health issues, or damages resulting from their participation in any of the activities.
Participants further agree to indemnify and hold harmless “MMC” and/or the cruise line from any damages, liabilities, or claims arising from their misconduct or misbehavior while participating in the activities.
“MMC” and/or the cruise line do not bear responsibility for guests participating in advertised activities or on shore excursions during the cruise.
36. VESSEL-RELATED ISSUES
The vessel itself is controlled and operated by the cruise line, not “MMC”. Therefore, you acknowledge and agree that “MMC” shall have no responsibility or liability of any kind to Passengers for any issues, claims or damages of any kind arising because of conditions on the vessel itself – such as, but not limited to, mechanical issues on board, vessel equipment, facilities provided on board (i.e., swimming pool, bars, furniture, etc.) food and beverages served on the ship, lodging conditions (including beds, room furniture, plumbing, electrical), and/or vessel health and safety issues.
37. LIABILITY
You acknowledge and understand that producing musical performances and appearances on a cruise ship involves building a stage, installing lighting and sound equipment, and setting up other related equipment, including wire and electrical equipment. “MMC” will use good faith efforts to do this in a safe manner. Nevertheless, you are directed to stay away from and not touch any such materials or equipment, as improper use or interference with such materials or equipment can result in injuries to your person, including, but not limited to falls. In addition, you are solely responsible to avoid any contact whatsoever, whether purposeful, inadvertent or accidental with any production materials or equipment that may be present in the general vicinity of the staging areas around the ship. As set forth below, “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors shall have no responsibility or liability for any injuries you suffer as a result of your purposeful, inadvertent or accidental contact with such materials or equipment.
By booking the Cruise, you and all persons booked on your reservation hereby release and hold harmless “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors, from and against any claim or cause of action arising out of or in connection with your travel on and participation in the Cruise, to the extent they are not attributable to such parties’ gross negligence or willful misconduct, including, but not limited to: (1) injury, illness (including COVID-19 or other communicable disease), death (for any reason, including communicable disease) or delay of Passengers, or loss, damage or delay of or to Passengers’ baggage or other property, which may be caused, directly or indirectly, in whole or in part, from participation in the Cruise, including, without limitation, exposure to other Passengers, vessel crew, and/or talent, conditions on board the vessel, Passenger’s use of or participation in any shore excursion, conditions at any port of call, and/or on board concession or athletic or recreational activity; (2) injury, illness, death or delay of Passengers which may be caused, directly or indirectly, in whole or in part, from Passenger’s venturing into areas containing equipment relating to performances, Cruise events, and/or Artists’ appearances (for example only, if Passenger is injured as a result of tripping over a lighting cord or sound equipment); (3) injury as a result of diminished capacity cause by alcohol or drug intake; (4) your selection of a roommate for the Cruise or the assignment of a roommate to you if no request is made by you; (5) emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances; (6) any postponement or cancellation of the Cruise (except as otherwise set forth herein); (7) any change in scheduled Cruise events and/or celebrity appearances; (8) violation of the Rules (including COVID-19 safety protocols) by you; or (9) injury, illness, or death caused by your exposure to other Passengers, Artists, and/or crew and/or spread of contagions among Passengers, Artists, and/or crew. You further agree that the “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by any of the them, nor for any intentional or negligent acts of any of their employees committed while off duty or outside the course and scope of their employment.
By participating in any activities organized by “MMC”, passengers acknowledge that they do so at their own risk. “MMC” and the cruise line accept no liability for any injury, loss, or harm that may arise from participation in these activities. Passengers are advised to take necessary precautions and are responsible for their own well-being during the event.
By participating in any excursions organized by the cruise line, passengers acknowledge that they do so at their own risk. “MMC” and the cruise line accept no liability for any injury, loss, or harm that may result from participation in these excursions. Passengers should be aware that these excursions are operated independently, and it is their responsibility to ensure their safety during these activities.
“MMC” will use reasonable precautions to try to prevent the spread of diseases on board during the Cruise, but it cannot make any guarantees in this regard, and cannot guarantee that Passengers, Artists and crew are and will be free of communicable diseases. As a result, as set forth above, “MMC” and cruise line shall have no responsibility for any illnesses (including, but not limited to, COVID-19) contracted by Passengers as a result of exposure on-board during the Cruise, and/or for any damages or losses suffered by Passengers (including, but not limited to, medical expenses), including death, as a result of exposure to other Passengers, Artists and crew during the Cruise.
38. COMPLAINTS AND CLAIMS
Passengers must raise any complaints, including, without limitation, any failure to provide a service forming part of the Cruise or any property damage or loss or injury, illness or death of a Passenger, immediately with “MMC” and confirm this in writing at the earliest possible opportunity. If any complaint arises during the Cruise which might give rise to a claim it must be notified immediately and written notice must be given to “MMC” as soon as possible and in any event within two (2) months (or, if a shorter period is prescribed under the applicable international convention then within that period) from the date on which the service was performed or when it should have been performed or when the property damage or loss or injury, illness or death occurred.
Within one (1) month of receipt of the complaint (or as otherwise provided for under the applicable international convention), “MMC” will give notice to the Passenger that his or her complaint has been substantiated, rejected or is still being considered. “MMC” will provide the final reply to the complaint within two (2) months of receipt of the complaint.
39. DISPUTES
Except where prohibited by law, all Passengers expressly agree that: (1) any and all disputes, claims and causes of action arising out of or connected with the Cruise shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in St. Petersburg, FL, United States to the exclusion of the courts of any other territory or country.
40. CHOICE OF LAW
All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms & Conditions shall be governed by and construed in accordance with the laws of the United States, without giving effect to its conflict of laws provisions. International conventions regarding carriage of passengers and luggage by sea shall also apply in any case.
41. MISCELLANEOUS
In the event of any conflict between the cruise line Terms and these Terms & Conditions, these Terms & Conditions will prevail.
All trademarks are the exclusive property of their respective owners, and you shall have no rights to use or display any such trademarks, including but not limited to trademarks of “MMC” and cruise line, without the express written permission of the trademark owner. The name of “MMC” and its trademarks, service marks, trade names, patents, copyright-protected materials and imagery may not be used without prior, specific, written permission from “MMC”, except by those travel agents who advertise, market and book “MMC” cruises. For all other purposes, whether commercial or personal, the transmission, use, copying or modification of the Images, in whole or in part, in any form or by any means, whether electronic, mechanical, by photocopy or recording, is strictly prohibited without the prior written consent or licensure of “MMC”. Unauthorized use of the imagery and the information contained herein may constitute a violation of applicable intellectual property, criminal, civil or privacy laws.
“MMC” makes no warranty, express or implied, with respect to the use of the links provided on the website, does not guarantee the accuracy, completeness, usefulness or adequacy of any resources, information, apparatus, product or process accessed via this website and is not in any way responsible for any errors or omissions in the resources or information accessed via this website or for the results obtained from the use of such resources or information.
The information contained on the website and material relating to the Cruise, including any information regarding Artists’ participation and programmed events, is subject to change at any time, in the good faith discretion of “MMC” and without notice. The details shown are for informational purposes only. “MMC” is not responsible for any errors, changes and/or omissions resulting in pricing, inventory or content discrepancies.
Passenger acknowledges and confirms that any travel agent utilized by Passenger in connection with the issuance of this ticket is, for all purposes, Passenger’s agent and “MMC” shall not be liable for any representation made by said travel agent. Passenger shall at all times remain liable to “MMC” for the price of the reservation.
In addition to the restrictions and exemptions from liability provided in these Terms & Conditions, “MMC”, the cruise line, and/or their respective officers, directors, principals, agents, employees, parents, shareholders, partners, subsidiaries, affiliates, predecessors, successors shall have the full benefit of any applicable laws providing for limitation and exoneration from liability, and nothing contained herein is intended to operate to limit or deprive the above parties of any such statutory limitation of or exoneration from liability. Without limiting the foregoing, the above parties claim benefit of all restrictions, exemptions and limitations of the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1974 as well as the Protocol to the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1976 (“Athens Convention”), which limits the liability of said parties for the death of or personal injury to a Passenger to no more than the applicable amount of Special Drawing Rights as defined therein, and all other limits on damage or loss to personal property.
These Terms & Conditions and the terms accepted during the Cruise reservation process contain the entire agreement between “MMC” and Passenger (and all persons included on the Passenger’s reservation) and supersedes any other agreements, written or oral, relating to the subject matter herein. Any waiver of any provision of must be made in writing and signed by an authorized representative of “MMC”. If any portion shall be determined to be invalid, then said portion shall be deemed severed from the present agreement in such jurisdiction only and all remaining portions shall remain in full force and effect.
